Withdrawal

§ 1 Right of Withdrawal

1. Consumers within the meaning of § 13 German Civil Code (BGB) generally have a statutory right of withdrawal in the case of distance contracts pursuant to §§ 355 et seq. BGB.
    

2. You have the right to withdraw from this contract within fourteen (14) days without stating any reasons.
    

3. The withdrawal period is fourteen days from the day of the conclusion of the contract.
    

4. To exercise your right of withdrawal, you must inform us:

by means of a clear declaration (e.g., a letter sent by post or an e-mail) of your decision to withdraw from this contract.
5. You may use the withdrawal form template provided below, which is, however, not mandatory.
6. To comply with the withdrawal period, it is sufficient that you send the notification of exercising the right of withdrawal before the expiry of the withdrawal period.

 

 

§ 2 Consequences of Withdrawal

1. If you withdraw from this contract, we shall reimburse you for all payments that we have received from you, including delivery costs (except for additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen (14) days from the day on which we received notification of your withdrawal from this contract.
    

2. For this repayment, we will use the same means of payment as you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees because of this repayment.
    

3. If you have requested that the services should commence during the withdrawal period, you shall pay us an appropriate amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal in respect of this contract compared to the total scope of the services provided under the contract (§ 357 (8) BGB).
    

 

 

§ 3 Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not exist, or expires prematurely, in the case of the following contracts:

• Contracts for the supply of digital content not on a tangible medium, if the entrepreneur has begun performance of the contract after the consumer
   

  • has expressly consented to the entrepreneur beginning performance before the expiry of the withdrawal period, and
     

  • has confirmed knowledge that such consent results in the loss of the right of withdrawal upon commencement of performance (§ 356 (5) BGB).
     

• Contracts for the provision of services, where the service has been fully performed and performance began only after the consumer
   

  • gave express consent, and
     

  • confirmed knowledge that the right of withdrawal is lost upon complete performance of the contract (§ 356 (4) BGB).
